This privacy policy (the “Privacy Policy”) forms part of the Terms and Conditions contained in the Terms of Use and has the purpose of clearly and precisely informing the advertisers (“Advertisers”) and users (the “Users”) of the services offered through the website hosted under the domain name https://beyondcampus.es or through the application named as Beyond Campus (hereinafter the “Website” and/or the “Application”) on the processing of the personal data gathered by the company BEYOND CAMPUS, S.L. (hereinafter, “BEYOND CAMPUS” or the “Company”).

This Privacy Policy applies to the Website, the Application and to the information that BEYOND CAMPUS collects through them, as well as through other means as, for example, through electronic communications or through electronic or paper forms.

According to the applicable Law, BEYOND CAMPUS informs Users that the data they provide through the Website and the Application will be included in data files which BEYOND CAMPUS controls.

The inclusion by Users of their personal data in the forms provided for their recollection, as well as the browsing through the Website or the Application and the provision of personal data during the provision of the services, entails of necessity and without reservations the awareness and acceptance of the present Privacy Policy, and therefore it is recommended that the Users read it carefully in advance.

In the event that the User provides data of third parties or shares and/or permits access to such data by other third parties or Users, said User declares that they have the consent of such parties and undertakes to transfer to them the information contained in this Privacy Policy, exempting the Company from any liability in this respect.

The present Privacy Policy is not applicable beyond the Website or the Application. BEYOND CAMPUS rejects any liability regarding any different privacy and personal data protection policies contained in any websites or applications which a User may access via any hyperlinks displayed therein.

Data required for data processing.

The provision by the Users of the data requested in the forms of the Application is totally voluntary, but not providing certain data in the registration processes or in the electronic or paper forms presented may make it impossible to access the services provided by BEYOND CAMPUS.

The Users shall be responsible, in all cases, for the veracity, accuracy, currency and authenticity of the personal data provided. BEYOND CAMPUS reserves the right to exclude from the services supplied any Users who have provided false data, without prejudice to any other actions which may correspond to it in Law.

Information used

On the Advertisers

  • Identifying data of the Advertisers or their legal representatives, such as name, surnames, passport or ID cards (this data would not be made public on the Website or the Application).
  • Contact information such as their e-mail address or postal address (this data would not be made public on the Website or the Application unless expressly requested).
  • Data on the properties, goods or services whose offer Advertisers wish to market on the Website or the Application, such as the following:
    • Addresses of the premises, houses, goods or services offered (the Website or the Application will not show the exact address, but only an approximate address, unless expressly requested).
      • Description of goods, services, real estate, etc. that Advertisers want to appear on the Website or the Application.
      • Basic minimum conditions that Advertisers wish to apply to potential contractors and that will accompany their offers.
      • Photographs that Advertisers would like to appear on the Website or the Application to illustrate their offer.

On the Users

  • Identifying personal data, such as forename(s), surname(s), passport or ID cards.
  • Contact details such as the postal or e-mail address and telephone numbers.
  • Payment data such as card number, expiration date, CVV, account details, etc.
  • Reviews. Users may provide their comments and evaluations on their experiences, which could be published on the Website or the Application.
  • Any other data which the Users may wish to include in order to complete their profile, such as photographs, workplace, position, hobbies and related information.

Purposes and legal bases of processing

BEYOND CAMPUS wishes to process the aforementioned data lawfully and, to this aim, said processing must be carried out on a valid legal basis. Accordingly, in addition to the acceptance of this Privacy Policy, BEYOND CAMPUS data processing is covered by the following legal basis

  • BEYOND CAMPUS uses this data to provide its services consisting of facilitating the rental of real estate for students, as well as the access to auxiliary services for the day to day of these students such as laundry, ironing, cleaning, etc. The data processing is necessary to be able to comply with the development of the contractual and pre-contractual relationship regarding the possibility of offering properties for rent, goods or services on our Website or Application and facilitating students the access to them. It is not possible for BEYOND CAMPUS to offer or render its services if this processing is not carried out.
  • BEYOND CAMPUS, likewise, can use all this data to know and evaluate the opinion on the services it provides and the products it supplies; as well as to process and solve any complaints or suggestions. BEYOND CAMPUS considers that it has a legitimate interest to perform such data processing in that it allows it to improve its services and the experience of the Users.
  • BEYOND CAMPUS also has a legitimate interest in using the data to know the features of its Users and customers as well as of the properties for rent, goods and services that will be offered by the Advertisers, in order to do be able to provide a better and more efficient service, e.g. to be able to provide the most useful recommendations on which of the services offered by Advertisers fit customers’ needs best.
  • BEYOND CAMPUS has a legitimate interest in using the data collected to contact Advertisers and Users and inform them of the services provided, for advertising purposes.
  • Moreover, BEYOND CAMPUS may process Users’ and customers’ data such as photographs, workplace, position, hobbies and related information in order to connect students with each others. BEYOND CAMPUS will do so only after having obtain the previous consent from the relevant data subject

Consent

By accepting the present Privacy Policy, Advertisers and Users acknowledge that they have read and understood its terms and expressly and unequivocally accepts its validity during the use of the Website or the Application and the provision of the corresponding services.

The Users will have to modify the data provided as they fall out of date, being responsible in all cases for the veracity and accuracy of the data provided at each moment. As the case may be, and without prejudice to any other actions which may correspond to it, BEYTOND CAMPUS reserves the right not to provide the services or to exclude any Users or Advertisers who provide false or incomplete data.

The Company accepts no liability whatsoever for any damages which may arise out of falseness or inaccuracy of the data provided, for which only Users and Advertisers shall answer.

Communication of data and international transfers

The personal data gathered via the Website or the Application will not be assigned to any third party to be used for its own purposes other than those for those specified in this Privacy Policy. However, other Users may access the personal data.

In addition, the data may be accessed by the authorized personnel of BEYOND CAMPUS and other third parties or collaborators who provide services in favor of the Company, with the purpose of managing the provision of services, the contractual and/or pre-contractual relationship with Users or process request made by Users. In these cases in which access to other collaborating companies is allowed, said access to data on behalf of third parties will be regulated in the corresponding contract as required by current regulations.

Some of the subjects who could access the data may be located outside of the European Economic Area, in countries such as the Unites States, which the European Union believes still do not have an adequate level of data protection: for example, their laws may not guarantee such users the same rights, or there may not be a control authority in data protection matters capable of processing their claims.

Notwithstanding the foregoing, BEYOND CAMPUS is concerned that, should data is shared outside the European Economic Area, the resulting international transfers are subject to any of the adequate guarantees described in the applicable regulations such as the signing of standard data-protection clauses or the subjection to a legally binding and enforceable instrument such as the Privacy Shield.

In addition, the Company may disclose the personal data gathered in specific cases in which such disclosure is established and requirable under the applicable regulations, or when so required by the competent authorities.

Conservation periods

The data will be conserved during the time strictly necessary for the purposes of the processing for which they have been provided, as long as the User has not revoked their consent and eliminated their personal data from the application, a possibility which remains open to them in a simple way at all times.

In any case, the personal data will be conserved at least as long as the subject in question continue to use the Website or Application and will be eliminated once it is considered that the service has been provided in a satisfactory manner.

Users’ Rights

Any User may, at any moment and by means of written communication, exercise the following rights:

  • Access: consulting what personal data of the User the Company has.
  • Rectification: modifying the personal data processed by the Company when they are inaccurate.
  • Erasure: requesting the Company to eliminate their personal data.
  • Portability: requesting the Company to deliver to them in an IT format the information it holds on the User.
  • Objection: requesting to the Company to cease in processing of Users’ personal data.

These rights must be exercised in a written document signed by the holder of the data, stating their home address, attaching a copy of their National Identity Document, passport or equivalent ID document, sent to BEYOND CAMPUS at the e-mail address support@beyondcampus.es or to the following postal address.
